State and Federal Rule Applicability and Inactivation Requirements For PWSs
- The definition of a public water system (PWS) is found in 40 Code of Federal Regulations (CFR) 141.2 (relating to Definitions) and 30 Texas Administrative Code (TAC) § 290.38(71) (relating to Definitions). However, there are certain conditions that exclude facilities, businesses, and districts from regulation as a PWS if they meet specific criteria as described in 40 CFR 141.3 and § 142.3 (relating to Coverage and Scope), and 30 TAC § 290.102(a)(1) – (5) (relating to General Applicability).
- Texas Drinking Water Solutions coordinates and completes the acquisition and submission of required compliance documentation to governmental entities for approval concerning the inactivation and consolidation of existing PWS such as:
- Customer Service Inspections;
- Sale Transfer Mergers;
- Certificates of Convenience and Necessity;
- Cross-Connection Control Enforcement Authority;
- Dissolution of Districts;
- Submetered or Allocated utility billing; and
- Proper inactivation of existing water sources and facilities.
- TDWS provides technical training and compliance assistance to owners, operators, and officials of PWSsm as well as facilities, businesses, and districts concerning state and federal rule requirements which permit the inactivation and consolidation of existing PWSs and exclusion of facilities, businesses, and districts from regulation as a PWS in accordance with applicability requirements as described in 40 Code of Federal Regulations (CFR) 141.3 and § 142.3, and 30 Texas Administrative Code (TAC) § 290.102(a)(1) – (5).
- TDWS provides cooperative regulatory coordination with TCEQ concerning state and federal rule requirements which permit the inactivation and consolidation of existing PWSs and exclusion of facilities, businesses, and districts from regulation as a PWS in accordance with applicability requirements as described in 40 Code of Federal Regulations (CFR) 141.3 and § 142.3, and 30 Texas Administrative Code (TAC) § 290.102(a)(1) – (5).
